General terms and conditions and use of the lockers

Object

These general conditions regulate the contracting of My Locker Granada (Smart City Ideas s.l) lockers through the website https://mylockergranada.com/ as well as their use. Likewise, these conditions regulate the contractual relationship between Smart City Ideas s.l. (My Locker Granada) and the User who contracts the My Locker Granada locker service.

The service

My Locker Granaday offers its users the possibility of renting any of its lockers for periods of calendar days (within the timetable offered by My Locker Granada).

What types of lockers does My Locker Granada offer?

My Locker Granada offers three types of lockers:

  • Size M lockers, measuring 28 cm (height) x 50 cm (width) x 80 cm (depth).
  • Size L lockers, measuring 59 cm (height) x 50 (width) x 80 cm (depth).
  • XL size lockers, measuring 90 cm (height) x 50 cm (width) x 80 cm (depth).

What can a user enter in his watchword?

Within the limits set out in this document (see, Section Limits on the use of lockers), a User may bring in as many items as he/she wishes, within the specified dimensions, so as not to overload the locker.

How can a User know if My Locker Granada lockers are available?

Through the website https://mylockergranada.com/, the User will be able to find out the availability of slots for the desired days for each User.

For how long can the same locker be rented for?

The User may hire the locker rental service for a minimum period of 1 day (12 hours).

When will the User be able to access the locker(s) he/she has rented?

The locker rental service will be accessible to the User 24 hours a day, any day of the week.

Once the User has inserted the packages, can he/she only access the locker again to retrieve them?

No, the User may access the rented locker(s) as many times as he/she wishes or needs during the rental period of the locker(s). Therefore, if the User has forgotten something or needs to access their locker during the day, they will be able to do so without any problem during the period they have booked.

What is the price to be paid by the User per type of locker/day?

The price per locker will be the price indicated on the website https://mylockergranada.com/ at the time of contracting, and the User may take advantage of the offers in force at any given time.

The prices shown on the website include VAT and refer to the rental of a locker (depending on its size) per calendar day.

How are lockers used?

The lockers offered through My Locker Granada are fully automatic. The User may make a reservation through our website https://mylockergranada.com/, indicating, in addition to his/her personal details, the number of lockers he/she wishes to rent, their size and the reservation period. Once the contract has been completed, the User will receive confirmation of the contract, the number of the reserved locker(s) and the security code to access his/her locker(s).

Therefore, the User will access their locker through the security code provided by Smart City Ideas s.l. when making their booking.

What can the User do if he/she has any kind of incident in the use of the locker?

In the event of a breakdown, blockage or any other type of incident in the use of the locker, the User will have the My Locker Granada assistance service at their disposal, which can be used by calling +34 672 849 594 or by writing to the following address hello@mylockergranada.com.

Can the User modify or cancel his/her reservation?

Yes, as long as such modification or withdrawal is made 24 hours before the date on which the service I have booked begins.

Access and booking

In order to hire the My Locker Granada lockers, the following requirements must be met:

  • Be at least 16 years of age or older.
  • Fill in truthfully and accurately the fields indicated on the form in the BOOKING section of the website (in particular, the following: name and surname, telephone, e-mail, date of booking, days of rental, number of lockers to be rented (indicating the size), data necessary to complete the payment, depending on the method of payment used).
  • Accept these general terms and conditions for contracting the service and using the ticket offices.
  • Accept the privacy policy of Smart City Ideas s.l, as owner of the My Locker Granada lockers.

Once the contracting process has been completed, the User will receive confirmation of his/her reservation by e-mail. This confirmation will indicate to the User the number(s) of slots allocated, the day(s) reserved as well as the access code(s) to the slot(s).

  • Purpose: Management of the reservation formalised by the User. Sending commercial communications by e-mail (My Locker Granada offers).
  • Legitimation: Execution of a contract through the formalisation of the reservation. Express consent in the case of commercial communications by e-mail.
  • Recipients: The data will not be communicated to third parties, unless legally obliged to do so.
  • Rights: Rights of access, rectification, opposition, limitation and cancellation, under the terms detailed in this section.
  • Additional information: For more detailed information on data protection, please read on.

The form referred to in the previous section, to be completed by the User, contains the data that Smart City Ideas s.l. needs to formalise the rental of the My Locker Granada lockers by the User and to be able to comply with the contractual obligations that will be derived for the parties from the locker service that the User, if applicable, contracts.

The User guarantees that all information about his/her identity and the reservation provided is true, accurate and complete.

The personal data provided will be used to manage the booking and to comply with the obligations arising for the parties to the consignment service. Smart City Ideas s.l. is legitimised to process the personal data provided in the contracting process by the User as they are necessary for the provision of the service. The User, by contracting, expressly consents to the processing of his/her personal data in the terms detailed herein.

Smart City Ideas s.l. will use the personal data of the Users of the passwords and, in particular, their e-mail address to send them commercial communications by e-mail about the services offered by Smart City Ideas s.lL. and its commercial offers. If the User does not wish to receive commercial communications from My Locker Granada by e-mail, he/she must tick the corresponding box during the contracting process. If, on the other hand, you agree to receive commercial communications by e-mail, My Locker Granada informs you that this consent may be revoked at any time.

On the other hand, the User is informed that there are video surveillance cameras at My Locker Granada. The purpose of these cameras is to monitor the status of the lockers at all times as well as the use made of the lockers by Users or third parties accessing the premises, with the aim of providing a better service by Smart City Ideas s.l. The My Locker Granada premises incorporate the corresponding notices about the video-monitored area in accordance with the provisions of current legislation on data protection.

The User has the possibility of exercising their rights of access, opposition, limitation, rectification and cancellation of their data, at any time, by requesting it in writing, identifying themselves (to which a copy of their DNI/NIE or passport must be attached) to: C/ Temple 3,18130 La Malahá (Granada) or to admin@mylockergranada.com. If the User, at any time, considers that the applicable data protection regulations have been infringed by Smart City Ideas s.l., he/she will be entitled to file a complaint with the Data Protection Control Authorities and, in particular, with the Spanish Data Protection Agency.

Smart City Ideas s.l. does not carry out international data transfers nor does it adopt automated decisions on the information provided by the User.

Smart City Ideas s.l. will keep the User’s personal data for as long as it is necessary to provide the service and for as long as it is necessary for Smart City Ideas s.l. to comply with its legal obligations. After this period, your data will be deleted. On the other hand, in any case, Smart City Ideas s.l. will keep your data as long as you have not revoked your consent to receive commercial communications by e-mail, if you have given it.

Obligations of the user, limits on the use of slogans

By contracting the My Locker Granada locker rental services, the User undertakes, in particular and without limitation:

  • To use the lockers for the sole purpose of depositing goods of your property, which you need to store temporarily in a safe place.
  • To use the lockers diligently and, in particular, to ensure that the locker is properly closed when the User leaves the premises (after inserting or removing the packages).
  • Not to use the lockers for illegal or unauthorised purposes. In particular, the User undertakes not to store objects whose mere possession or trafficking is illegal (such as stolen objects, drugs, pornographic materials or, in any way, materials degrading to human beings, etc.).
  • Not to deposit any property the possession of which requires a licence without such a licence or authorisation (e.g. weapons).
  • Not to insert any polluting or hazardous materials (such as flammable objects or dangerous substances) in the lockers.
  • Not to use the lockers to deposit animals or any kind of living being.
  • Not to insert food in the lockers, unless it is packaged food that cannot spill, stain the lockers or produce odours of any kind on the premises of My Locker Granada.
  • Not to provide your security key to any third party, being fully responsible for the breach of this obligation and its consequences.
  • Not to use the lockers to deposit goods to be collected by a third party. The lockers should not be used as a means of trafficking in goods between parties. This use is not authorised by Smart City Ideas s.l.
  • To access and remain on the premises for the sole purpose of accessing the rented locker and only to carry out a specific action in relation to the packages inserted. The User may not remain on the premises for longer than is strictly necessary.
  • Not to eat or drink on the premises.
  • To remove the packages inserted in the rented locker(s) before 23:59 hours on the day on which the rental ends.
  • To leave the lockers, at the end of the service, in the same condition in which they were found and, in particular, to notify My Locker Granada at hello@mylockergranada.com of any incident that the User may encounter in the use of the lockers or in their condition.
  • Not to take photographs or videos inside the premises of My Locker Granada and, in particular and without limitation, not to take photographs or recordings of the security mechanisms of the premises.
  • Not to include in the lockers money, jewellery, technological items (tablets, computers, televisions, etc.) or goods of special value, being the sole and exclusive responsibility of the user the decision to use the rented lockers to store this type of goods of special value.

Consequences and liability of the user in case of non-compliance with his obligations

The User shall hold Smart City Ideas s.l. harmless for any damages arising from the breach of their obligations arising from this contract.

Non-compliance with the rental period

In particular, in the event that the User does not empty the rented locker/s on or before the expiry date of the rental, Smart City Ideas s.l. will be authorised to access the lockers to remove the stored packages, with the aim of freeing them up to allow their ordinary use by Smart City Ideas s.l.’s clients. If necessary, Smart City Ideas s.l. will temporarily store the packages and will try to contact the User who has not complied with the rental period in order to arrange for the return of the packages to the User (the cost of which will be borne 100% by the User). After fifteen days have elapsed without having been able to contact the User or without the User having contacted Smart City Ideas s.l. and without having been able to send the packages to the User, it will be understood that the goods have been abandoned by the User for all purposes. In this case, Smart City Ideas s.l. will cease to keep them and will dispose of them as it deems appropriate or convenient, depending on the type of abandoned goods.

For each day that elapses from the expiry of the rental period without the locker/s having been released by the User until it is delivered to the User or collected by the User, an amount equivalent to the price of the locker that has not been collected will be charged per day. In addition, a penalty of €150 will be payable by the User to Smart City Ideas s.l., irrespective of Smart City Ideas s.l.’s right to claim for damages actually suffered.

Unless the User collects the packages personally, Smart City Ideas s.l. will arrange for the shipment of the packages to the User, subject to payment of the service to Smart City Ideas s.l. by the User. In particular, where applicable, the User must pay Smart City Ideas s.l. €25 per package, if the shipment is to be made within Spain, and €50 per package, if the shipment is to be made outside Spain. Delivery shall be deemed to have taken place from the moment Smart City Ideas s.l. hands over the packages to the carrier, Smart City Ideas s.l. not assuming any risk for the transport of the packages.

The refund will be made once Smart City Ideas s.l. has received payment from the User of the amounts due for the delivery of the goods (according to the number of packages and destination) in accordance with the provisions of the previous paragraph. If 10 calendar days after Smart City Ideas s.l. has communicated in writing the amount to be paid, the User has not made the payment, it will be understood that the packages have been abandoned for all purposes by the User, and Smart City Ideas s.l. will proceed in the terms specified above for abandoned goods.

Non-compliance with the proper use of lockers

Smart City Ideas s.l. reserves the right to remove any object that does not comply with the rules of use of the lockers and is a prohibited object. In such cases, Smart City Ideas s.l. is authorised to call the police and report the conduct, as well as to remove the prohibited objects.

The User shall be responsible for the objects he/she inserts in the slogans.

In any case, the removal of the prohibited packages will entail a penalty of 150€, a penalty that will not exclude the obligation of the non-compliant User to compensate Smart City Ideas s.l. for the damages actually caused.

Damage caused to lockers by Users

The User shall be fully responsible for any damage or deterioration that may be caused to the lockers due to improper or inadequate use. In this case, the User must compensate Smart City Ideas s.l. for any physical damage caused to the locker/s as well as for any loss of profit.

In particular and without limitation, the User causing the damage shall pay Smart City Ideas s.l. a penalty of the daily rent for each day that the locker is unusable, as well as the cost of repair or replacement, which is quantified in the case of replacement at €1,000, regardless of the damages caused.

Payment of penalties

The penalties detailed in this section shall be paid by the User by the same means of payment used by the User when contracting the service or by bank transfer to the account indicated by Smart City Ideas s.l. if requested by the User. The User expressly accepts that Smart City Ideas s.l. may proceed to collect the amounts established in this section using the User’s card or means of payment when contracting the service.

Obligations of Smart City Ideas s.l.

Smart City Ideas s.l. undertakes to keep the locker service active and to make available to the User, during the contracted time, the locker or lockers that the User has contracted in a good state of use.

Likewise, Smart City Ideas s.l. undertakes to resolve any incident that may arise in the use of the slogans as soon as possible.

Limit of liability of Smart City Ideas s.l.

Smart City Ideas s.l. undertakes to keep the locker service active and to make available to the User, during the contracted time, the locker or lockers that the User has contracted in a good state of use.

Likewise, Smart City Ideas s.l. undertakes to resolve any incident that may arise in the use of the slogans as soon as possible.

Complaints

If the User considers that he/she has grounds for a complaint, he/she may do so by sending an e-mail to the following address admin@mylockergranada.com.

Smart City Ideas s.l. will try to resolve the incident and find a satisfactory solution for both parties.

In the event that the User is not satisfied with Smart City Ideas s.l.’s response, he/she has the option of submitting a complaint form to the consumer authorities of the Community of Andalusia. Applicable law and jurisdiction

These General Conditions are governed by Spanish law. The parties submit to Spanish jurisdiction to resolve any dispute arising in connection with this Agreement.
